Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Sayver (“Sayver,”“we,” “us,” or “our”) governing your access to and use of the Sayver website, dashboard, scanners, monitoring scripts, APIs, and related services (together, the “Service”). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Agreement to these terms
By accessing or using the Service, creating an account, or clicking to accept these Terms during sign-up, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not access or use the Service.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. The Service is not directed to children, and you may not use it if you are barred from doing so under applicable law.
3. The Service
Sayver helps you find and understand potential security issues in applications, including applications built with AI coding tools. Depending on your plan, the Service may include:
- A site scanner that inspects a website or domain you provide and reports potential misconfigurations and exposures;
- A code scanner that, with your authorization, reads connected source code repositories to perform static analysis;
- A live threat scanner and runtime monitoring that ingest telemetry from a script you install on your own application; and
- Plain-English explanations, suggested fixes, alerts, security scores, and reports.
The Service is provided for informational and diagnostic purposes only. It is a tool to assist you and is not a substitute for professional security review, audit, or legal/compliance advice. We may add, modify, or remove features at any time.
5. Accounts & teams
Authentication and account management are provided through our identity provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at contact@sayver.co of any unauthorized use.
Some plans support organizations with multiple members (“seats”). If you invite or manage team members, you are responsible for their access and use of the Service and for ensuring they comply with these Terms. Seat and project limits depend on your plan.
6. Subscriptions & billing
Paid plans are billed on a recurring basis (monthly or annually) through our billing and payment processors. By subscribing, you authorize us and our processors to charge your payment method for the applicable fees, including any taxes, on a recurring basis until you cancel.
- Free trial. We may offer a limited number of free scans. Once exhausted, a paid subscription is required to continue using the relevant features.
- Renewals. Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled beforehand.
- Cancellation. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Refunds. Except where required by applicable law, fees are non-refundable and we do not provide refunds or credits for partial periods or unused features.
- Price changes. We may change prices; we will give reasonable notice, and changes apply to the next billing period.
Card details are handled by our payment processor; Sayver does not store full payment card numbers. See our Privacy Policy for details.
7. No warranty / “as is”
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Security scanning is inherently imperfect. Sayver does not guarantee that it will detect every vulnerability, misconfiguration, threat, or issue, that its findings are complete or accurate, or that issues it does not report do not exist. A clean or high score does not mean your application is secure. Findings, scores, and suggested fixes are advisory only. You remain solely responsible for the security, operation, compliance, and backups of your own applications and data, and for independently verifying and acting on any results.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAYVER AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM A SECURITY BREACH, VULNERABILITY, OR ISSUE THAT THE SERVICE DID NOT DETECT OR REPORT, OR FROM YOUR RELIANCE ON ANY FINDING, SCORE, OR SUGGESTED FIX.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO SAYVER IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless Sayver and its owners, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your scanning, probing, or monitoring of any system you did not own or were not authorized to assess; or (d) your violation of any law or any third party’s rights.
10. Intellectual property & your data
The Service, including its software, design, and content, is owned by Sayver and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not use our name, logo, or branding without permission.
You retain ownership of the data you submit or that we collect from your systems (“Your Data”), including scan targets, repository contents accessed for analysis, and runtime telemetry. You grant Sayver a worldwide, non-exclusive license to host, process, and use Your Data as needed to provide, secure, maintain, and improve the Service, and to generate aggregated or de-identified analytics that do not identify you. Our handling of personal data is described in the Privacy Policy.
11. Third-party services
The Service relies on third-party providers (for example, for authentication, hosting, databases, payments, email, AI processing, and source-code access). Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services, and links or integrations do not imply endorsement. A current list of the providers that process personal data is in our Privacy Policy.
12. AI-generated output
Some explanations and suggested fixes are generated with the help of third-party AI models. AI output can be incomplete, inaccurate, or inappropriate for your specific situation. You are responsible for reviewing and testing any suggested change before applying it. Do not rely on AI-generated output as professional advice, and never paste secrets or sensitive credentials into prompts.
13. Termination & suspension
You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or used the Service in an unauthorized or harmful way, or if required by law.
Upon termination, your right to use the Service ceases. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
14. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and applicable U.S. federal law.
Informal resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@sayver.co. We will try to resolve it within 60 days.
Binding arbitration & class-action waiver. To the extent permitted by law, any dispute not resolved informally will be resolved by binding individual arbitration rather than in court, except that either party may bring claims in small-claims court or seek injunctive relief for misuse of the Service or intellectual property. You and Sayver waive any right to a jury trial and to participate in a class action or class-wide arbitration. If this class-action waiver is found unenforceable, the remainder of this section will not apply to that dispute, which will proceed in court. Exclusive venue for any matter not subject to arbitration is the state and federal courts located in Delaware, and you consent to their jurisdiction.
15. Changes & miscellaneous
Changes.We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Sayver regarding the Service.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
